I understand and agree that by submitting the payment and my information, I am entering into a
contract for legal services. These services include drafting legal documents, legal research, client
communication, settlement negotiations, motions, travel time, and court appearance(s).
All additional legal matters such as appeals, review hearings, show cause hearing(s) will require
a new flat fee agreement and additional attorney fee. Further, if this traffic infraction is upgraded
to a criminal charge, this fee agreement is null and avoid and will require a new agreement.
FLAT ATTORNEY FEE
I understand that the attorney fee I paid to the attorney does not include any fines, fees, and costs
imposed by court or any third party and the attorney will not reduce or refund his fee to cover or
compensate me for those costs.
I understand that the attorney fee shall be a flat fee, paid at the time of this agreement. The
attorney fee will be deposited into attorney’s operating account and shall be attorney’s property,
and will not be the property of the client or placed in a client trust account. The fact that client
paid this fee in advance does not affect client’s right to terminate the client-lawyer relationship.
In the event the client-lawyer relationship is terminated before the agreed-upon legal services
have been completed, client may or may not have a right to a refund of a portion of the fee.
NO GUARANTEES
I understand that there is no guarantee of a dismissal or otherwise keeping my current violation
off my record, but that keeping the violation off my record is the attorney’s goal and every effort
will be made to obtain that result.
I have been advised that an amendment to a violation that should not appear on my driving
record still carries a fine that must be made to court, and is not included in the attorney fee. I
understand that this fine may be higher than the fine that is on the face of my current ticket.
I specifically authorize attorney to obtain a deferred finding on my behalf only if there is no
other possible way of obtaining a not-committed finding, dismissal, or amendment to a violation
that will not appear on my driving record. I understand that a deferral carries a deferral fee that
must be paid to court and is not part of the attorney fee.
POTENTIAL REFUND
I understand that the attorney will refund his attorney fee in its entirety if the original moving violation is not dismissed, reduced to a non-moving violation, entered into a deferred finding, or reduced to a less serious charge, e.g., Negligent Driving reduced to Speeding.
